Ponder This: The American Flag From A Patriot
If I am charged with guarding the flag, while in a military capacity, I would run the pike through you if you attempted to take it. As such, individual owners have a right to defend personal property depending on their state laws including, but not limited to bodily injury up to deadly force.
If I were some moron out there wanting to destroy something I paid for, and you stopped me or tried to take away my personal property to attempt to "save it" I would be justified, again depending on the state, in shooting you dead. Thus, the same holds true for some liberal trying to be edgy.
So without a constitutional amendment, the issue has been covered repeatedly and without congressional legislation, no president has the power to dictate anything and therefore a moot point. If you want it that bad, make it an amendment, otherwise in about a year or so after such a law is passed, SCOTUS will rule against it.
Cities are at an advantage however, as they can regulate when and where a fire is set. There's your easy kill switch.
I do not approve of flag burning but there's not a thing anyone can do about it in the field without risk of being injured, killed or arrested for assault or theft. Such is the nature of Liberty, it doesn't always allow for control like you want.
With all that being said, if a flag sits on top of a capital building and someone tries to wreck it, go get them. It's the People's flag, not theirs.
On the other side of this issue is a common sense problem. How do you complain about releasing toxic fumes into the atmosphere and contributing to climate change while igniting a flag and releasing toxic fumes into the atmosphere?
